Appeal court revokes cancellation of the mark HAPAG-LLOYD

HAPAG-LLOYD, global liner shipping company operating at 300 locations in 114 countries and which transports five million containers (TEU) in a year, succeeded in obtaining at the appeal instance the reversal of the first instance decision by which HAPAG-LLOYD’s Peruvian Trademark Registrations were cancelled on the grounds of non-use, primarily because the Trademark Office was of the opinion that such marks were used as a trade name and not as a service mark.

After having examined the submitted evidence material – comprising more than 1500 documents proving that the mentioned mark is being used - the Appeal Court of the Peruvian Trademark Office revoked the first instance decision, determining that the “HAPAG-LLOYD” mark is to remain in the register.
